Terms of Service

Nacho Labs, LLC — Effective Date: January 2025

1. Acceptance of Terms

By using Nacho Labs, LLC's services, you agree to be bound by these Terms of Service ("ToS"). If you do not agree, you must discontinue use immediately.

2. Services Provided

Nacho Labs, LLC offers the following services:

  • ›Shared hosting, VPS, and dedicated servers
  • ›Domain registration
  • ›SSL certificates
  • ›Resold cloud servers
  • ›Web mastering services (retainer-based)
  • ›Web development & design (contract-based)

3. User Responsibilities

Users must not engage in:

  • ›Illegal activities, including copyright infringement and fraud
  • ›Spamming or bulk email abuse
  • ›Excessive resource usage beyond allocated limits
  • ›Hosting malware, phishing, or other malicious content
  • ›Any activity that disrupts Nacho Labs' infrastructure

Nacho Labs, LLC reserves the right to suspend or terminate accounts violating these rules.

4. Payment & Refund Policy

  • ›Refunds: Only available for hosting packages within 30 days, at Nacho Labs' discretion. No refunds for domains, SSL certificates, or contract-based services.
  • ›Late Payments: Hosting services are suspended after 15 days of non-payment. After 30 days, all data is permanently deleted. Contract-based services with unpaid balances are subject to arbitration and collections.
  • ›Auto-Renewals: Services renew automatically unless manually canceled by the user.

5. Suspension & Termination

  • ›Non-Payment: Accounts are suspended 15 days after a missed payment and permanently deleted after 30 days.
  • ›ToS Violations: Immediate suspension for any activities or content outlined in our Acceptable Use Policy (AUP).
  • ›Reinstatement Fee: Applies to accounts suspended for ToS violations.

6. Limitation of Liability

  • ›Nacho Labs, LLC does not guarantee 100% uptime.
  • ›We are not liable for data loss, hacking, service interruptions, or any damages resulting from use.
  • ›Users are responsible for backing up their data.
  • ›Services are provided as-is, without warranties.

7. Governing Law & Dispute Resolution

  • ›These ToS are governed by the laws of the State of Georgia, USA.
  • ›Any disputes will be resolved through binding arbitration rather than litigation.

8. Modifications to Terms

Nacho Labs, LLC reserves the right to modify these Terms at any time. Continued use constitutes acceptance of the revised terms.

Acceptable Use Policy (AUP)

1. Introduction

This Acceptable Use Policy ("AUP") outlines prohibited activities and responsible use of Nacho Labs, LLC's hosting and web services. Violation of this policy may result in suspension or termination of services.

2. Prohibited Activities

Users may not engage in activities including, but not limited to:

  • ›Illegal Content: Hosting or distributing copyrighted, illegal, or obscene material.
  • ›Security Violations: Engaging in hacking, phishing, or other unauthorized access attempts.
  • ›Spam & Email Abuse: Sending bulk unsolicited emails, spamming, or email harvesting.
  • ›Resource Abuse: Excessive use of CPU, bandwidth, or storage that impacts other users.
  • ›Malicious Activity: Distributing malware, viruses, or any malicious software.
  • ›Fraud & Misrepresentation: Impersonation, fraud, or misrepresenting identity.

3. Content Restrictions

Prohibited content includes:

  • ›Child exploitation material, hate speech, and defamatory content.
  • ›Copyrighted content without authorization.
  • ›Illegal gambling, controlled substances, or any prohibited goods.

4. Network & Security

Users may not:

  • ›Conduct network scanning, denial-of-service (DoS) attacks, or other exploits.
  • ›Use services to compromise the security of third parties.

5. Enforcement & Penalties

  • ›Immediate Suspension: Services may be suspended or terminated without notice for severe violations.
  • ›Reinstatement Fee: A reinstatement fee applies for accounts suspended due to AUP violations.
  • ›Legal Action: Nacho Labs, LLC reserves the right to cooperate with law enforcement.

6. Changes to This Policy

We may update this AUP at any time. Continued use of services constitutes acceptance of the revised policy.
